Chapter 13 bankruptcy is sometimes referred to as "reorganization" bankruptcy. Under it, the individual reorganizes his or her finances, allowing him or her to retain all property and continue debt payment on a reduced level through debt forgiveness and debt consolidation. It also offers highly effective tools to avoid foreclosure and reinstate faltering mortgages.
Under Chapter 13 consumer bankruptcy, the debtor proposes a plan to the court and creditors to repay debt over a three- to five-year period. During the repayment period, creditors cannot collect or attempt to collect on previously incurred debt except through the court. Payments are reduced and can affect most types of debts, with the exception of taxes, child support, alimony, and car and house payments.
Chapter 13 bankruptcy uses the debtor's court-defined "disposable" income to repay debts. Non-disposable income is left with the debtor for living expenses. Debtors who do not have significant disposable income are often ineligible for Chapter 13 debt relief as there is insufficient income left over for debt payment after all living expenses have been paid.
