Michael E Benson Columbus, Ohio, Bankruptcy Law Attorney

Unmanageable personal debt or business debt can result from a long list of possible causes including illness, divorce, unfamiliarity with financing planning, a changing business climate and predatory lending practices, among many others. Yet no matter the cause of the debt, the result is always the same -increasing anxiety as unpaid bills continue to mount, creditor harassment persists, and the hopes for a solution fade.

Bankruptcy protection is a compelling alternative when your property and your quality of life are threatened by unmanageable debt. If you are struggling to pay bills and other options for evening out cash inflows and outflows are simply not working, it may be worth your time to speak with an experienced bankruptcy lawyer who can help you consider all of your options.

At the law office of Michael E. Benson, Attorney at Law, we assist clients with filing for the following types of bankruptcy:

  • Chapter 7: In Chapter 7 bankruptcy, an individual surrenders non-exempt property for liquidation. The proceeds from the sale of these non-exempt assets are then used to pay creditors. In approximately 95% of the cases I handle, the individual does not have to give up his or her car or house.

  • Chapter 13: In Chapter 13, the individual keeps all of his or her assets and commits a share of future income to making reduced payments to creditors over a period of time, usually ranging from three to five years.

  • Business Bankruptcy: Business bankruptcy usually falls under Chapter 7 or Chapter 11 formats. Chapter 7 is most common with small business and involves liquidation of assets and termination of the business. Chapter 11 allows for a reorganization or rehabilitation of the business with accompanying reorganization of debt payments.

Financial problems are unfamiliar territory for many people. As such, it is advisable to speak with an experienced bankruptcy attorney to determine if bankruptcy offers the best solution to your debt problems.

When I knew I needed to file Chapter 13 to save my house, I knew little about the process. More importantly, I had no idea who to trust to help me through the maze of paperwork and regulations about what was required. The thing I liked about Mike Benson was his understanding of the law and his ability to quickly answer any questions about what was required and what that meant for my particular situation. I had MANY questions and Mike always responded quickly and specifically to my sometimes daily inquiries. His responsiveness is superb and I am extremely happy with his help in my case. I highly recommend Mike to anyone needing legal advice about statutory financial protection.
